Can a private lender (bank) evict the spouse of the owner of a newly built home on title?
private lending company that financed but defaulted on a builder who was building home for himself and caused the builder and his wife to get into large debt trying to complete the home after the lender defaulted on them is now trying to sell the home now that it has just been completed. Is the lender legally able to evict the builder (who is on title) or his wife from the home? Does dowry have any standing in this case. Does the builder (legal owner) of the home or his wife have any legal recourse or defense against the lender since he had defaulted and caused them to invest all their money and subsequently got them into large debt in order to complete the home?
